 Jonathan Browne - February 19, 1690/1

   I Jonathan Browne of Watertown in the Countie of Middlesex in the
Massachusets colonie in New England being under the afflicting hand of god
and not knowing what the good pleasure of god may be concerning me but
throo the good hand of god am at present sound in my membory and of a
disposing mind doe declare this to be my last will and testament in manner
as Followeth
   I returne my spirit to god that gave it and my bodie to the earth from
whence it was takain hopeing throw the merits of the Lord Jesus Christ my
blessed redeemer to have a glorious resurection both of soul and bodie at
the was[?] and last day and as for the outward estate that god have lent
mee:
   my will is that my deare and loveing wife Mary Browne shall injoy my
whole estate as long as she liveth my widdow for her comfort and
maintenance and the bring up of four of my children that are as yet but
small onely my will is that my grand child James Bigolo be payd five pound
in curant contry pay to him or his gardian when he shall attaine the age
of fowreteen years
   Allso my will is that after my deare and Loveing wives desease or
marieng againe: if god shall conterie the lives of my children which are
eight in number: that my said estate be parted into seven shares: and my
five sons and my daughter Lidea to have six parts of my said estate and my
other two daughters one share of my said estate between them and my will
is that if any of my children aforesaid should dy without leaveing any
Lawfull Issue that theire part so dieing shall returne to my sons: but if
any of my said childrin now liveing should die and leave any child or
childrin lawfully begoten that they shall injoy what was the right to
theire parant acording to the rule aforementioned
   Allso my will is that my sons shall injoy my houseing and land and pay
to their sisters their proportion acording to the rule aforesaid to be
paid in good and curant contry pay within two years after my estate come
to bee devided
   Finally I doe nominate and apoynt my deare and Loveing wife and my
wellbeloved son Abraham Browne to be my executors to this my last will and
testament and as [ ? ] hereunto I have set my hand and seale this
nineteenth of February sixteen hundrid and nintee

Will of Peter Aspinwall - November 20, 1687

In the name of God, Amen, my soul I commit into the arms of Jesus Christ
my Saviour, my body to be decently buried: after necessary expenses are
defrayed, my just and lawfull debts satisfyed, my estate divided in manner
following, my will is, that my beloved wife Remember Aspinwall be my
executrix and that she shall have one third part of my whole estate with
her choice of which part, to continue the time of her widowhood: if she
change her condition, then to leave the houseing & land to my children,
and the moveables to be at her disposing.
2. That my eldest son Samll Aspinwall be my executor and that he have a
double portion of my estate, if after division of my estate anything be
put to sale, he to have the first refusall of it.
3. That my second son Peter Aspinwall to keep what of my estate he has in
hand, if it be more than his just proportion, not to return any back; yet
if he have not equal to ye rest of my children then to be made up out of
my estate.
4. That all the rest of my children, Nathaniel Aspinwall, Thomas Aspinwall,
Joseph Aspinwall, Eleazar Aspinwall, Timothy Aspinwall, Mehetable Aspinwall,
Elizabeth Aspinwall, Mary Aspinwall, that they have an equal proportion of
my estate: In case any of those dy before they be of age to make a will,
that then his or her proportion be divided equally among the rest. I do
give power to my executrix and executor to call in any debt by bill or bond
to improve for the good of the whole. Also that corne meat as provision for
ye family for this yeare be not put into the estate but for the children's
use.
This is the last will and testament of Peter Aspinwall this 20th of November
one thousand six hundred eighty and seven; as witness my hand and seale.

Will of Joseph Kellogg - June 27, 1707

   Upon the twenty-seventh day of June One Thousand Seven Hundred and seven
in the sixth year of the Reign of our Lady Anne by the Grace of God, of
England, Scotland, France & Ireland Queen, Defendr of the Faith &c I Joseph
Kellogg of Hadley in ye County of Hampshire within the province of the
Massachusetts Bay in New England I hope having a suitable sence of the many
infermities, the considerable old age that I am now come to hath exposed me
to all which giving me warning that I must shortly when it pleases God to
call yield to Death and Lay down this Earthly Tabernacle, Being at Present
Through the Great Goodness of God of sound mind and perfect memory and
accounting it my Duty to set things In order with Reference to that Portion
of Estate God in Goodness hath Given me and Therefore I do make this my Last
will & Testamt as followeth
   Imp. I commit myself soul and body Into the hands of God who made them
and my dear Redeemer The Lord Jesus Christ who hath Redeemed them and in
whom I Trust & Believe will be my advocate with the Father at the Great day
of his Appearing. And in and through his Merits & Satisfaction to obtain
acceptation, My Body which I leave to my Executors for a Christianly, Comely
Burial in hopes of a Blessed Resurrection when soule and Body Shall by the
Mighty Power of God be reunited and be wth him forever in that Place of
Everlasting Rest when sorrow and Sighing shall flee away and Joy and
Rejoicing Shall be upon the head of the Righteous with Hallelujahs and
Praises to God the Father Son and Holy Ghost forever and ever, Even to Never
Ending Eternity, Amen.
   It. I ordain and my will is that all my Just Debts and Funeral expenses
be well and truly paid by my Executors hereafter named.
   It. I Give and Bequeath unto my Loving Son John Kellogg all that piece of
land on which he now lives it being bounded by the Dividing fence East on
Land of Sam'll Partride West on an Highway North, and on the River south to
be to him with this Proviso that either of his sons Joseph or Samuel after
his decease Shall enjoy it to him that posses it to be to him and his heirs
forever but in case they both Dye before Either of them Posses it then to
revert to my family from whence it came. The Intent of .... that land that
lies within the Town Ditch. Also I give to my son John Kellogg abovenamed
four acres of my forty acre Alotment lying at the Fort River at the South
end of s'd Lot this together with about Ten Pounds I have already given him
to be to him and his heirs forever.
   It. I give and bequeath to my son Martin Kellogg, four Acres of my forty
acre alotment at the Fort River in Hadley next to that I have given to my
son John above-said -- Also besides what I have given him already which I
account at Sixteen Pounds -- I give him Twnety Shillings in curr't Country
Pay, all which to be to him & his heirs forever.
   It. I give and bequeath to my loving son Edward Kellogg the full sum of
five pounds in Currant Country Pay which together with what I have already
given him which I esteen at Sixteen Pounds to be to him and his heirs
forever.
   It. I give and bequeath to my son Saml Kellogg four acres of my forty
acre alotment at Fort River in Hadley next to that I have given to my son
Martin Kellogg as abovesaid which together with five pounds I have already
given him to be to him and his heirs forever.
   It. I give and bequeath to my daughter Joanna Kellogg alias Smith and
Sarah Kellogg alias Ashley together with what I have already given them
which I esteem to be fifteen pounds a piece I give them forty shillings a
piece to be paid them by my Executors in such pay and at such time as it can
be made good to them out of my estate.
   It. I give and bequeath to my loving sons Stephen Kellogg & Nathaniel
Kellogg, considering that I had a considerable estate with their mother out
of Father Terry's Estate therefore I give to them all that alotment that was
my Father Terry's lying in Hockanum in Hadley bounded by the land of John
Smith northeast and the land of Thomas Hovey southwest abutting on the River
both North & South to be equally divided to them after my wife's decease,
not to have ye use or possession of said land till then and then to be to
them and their heirs forever. This together with forty shillings a piece I
have already given them I account a full portion for them
   It. I give and bequeath to my loving daughters Elizabeth Kellogg, alias
Nash, Abigail Kellogg alias Smith, Prudence Kellogg alis Merrill, as an
addition to what I have already given them which I esteem fifteen pounds
apiece, forty shillings apiece in such pay and at such time as my Executors
can make it good to them out of my estate.
   It. I give and bequeath to my loving sons Ebenezer Kellogg & Jonathan
Kellogg my allotment in the Plain in the Great Meadow in Hadley, bounded by
land of Nathaniel White east and land of Timothy Eastman west abutting on
Highway South and the adjacent furlong North, as also I give them ten acres
of my forty acre allotment at Fort River next unto my son Saml gift there,
both lots to be equally divided between them to be to them and their heirs
forever. Also I give unto them eight pounds a piece in such time and in such
pay out of my estate as my executors hereafter named can do it.
   It. I give and bequeath to my loving son Nathaniel Kellogg four acres of
my forty acre allotment at Fort River at the North East and it going to the
lands of Timothy Eastman to be to him and his heirs forever.
   I give and bequeath to my son Joseph Kellogg all that my allotment in the
Plain on the East side of the Town in Hadley, containing sixteen acres or
thereabouts as also I give him twenty-five pounds out of my estate to be
paid to him in or as good country pay, to be paid as my executors can and at
such time as they can do it. And Whereas my son Joseph approving himself a
loving son in his care and helpfulness to me in my weak condition and to my
wife I'll recommend it to my wife to make such further additions out of the
Housing land or other estate I have reserved to her dispose as may be
encouragement and recompense to him for his care and trouble as aforesaid.
   It. I give and bequeath to my Dear and loving wife Abigail who hath born
the burthen with me in all my long continued weakness and infirmities my
house and homestead with my barn and outhousing, Orchards, Gardens, yards,
situate in Hadley aforesaid as also that alotment next to Saml Smiths
alotment as we go to the For Meadow in Hadley with all other of my lands in
Hadley or elsewhere not given in this my will otherwise with all rights of
our Lands or Commons or any lands that may grow to be of right to me within
the bounds of the Township of Hadley or elsewhere with all moveable goods or
estate within doors or without in Hadley or elsewhere to be for her
comfortable livelyhood while she lives, She keeping the Housing and Barns in
good repair as also I give her full liberty to remove the Houses Barns or
Fences as she shall judge best and most advantagious for her and them that
may enjoy it after her demise. As also I hereby give her full liberty and
power provided by good advice she see cause to make sale of sd Housing and
Homestead, then to do it, provided always all the said estate that she shall
leave either for the aforesaid housing and lands and moveable estate when
she dies it shall be by her disposed of amongst those children I had by her
and to them or any of them as she shall see meet to disposit.
   It. I hereby order and it is my will that as to those gifts I have given
in this will in moveable goods to several of my children if any moveable
goods, chattels, credits will not reach to the payment of my debts, funeral
expenses and other charges and uses I may have for it while I yet live and
for so much reserve for my wife's necessity while she lives a widow that
each legatee in proportion to their gifts the sum of them all shall abate
accordingly.
   It. I ordain, constitute & appoint my dear & loving wife Abigail Kellogg
and my loving frind Capt. Samuel Partridge to be joint executors of this my
last will and testament adnulling and making void all former or other will
or wills, testaments by me formerly or otherwise made, and this to be taken
unproved and holden to all intents and purposes my last will and testament
to which I subscribe and seal this 27th June, 1707, the day and year above
written.

Will of John Higley - May 6, 1714

   The Last Will and Testament of John Higley of Symsbury, in the County of
Hartford, and Colony of Connecticut, in New England, which is as followeth
-- Being under many weaknesses, age, and infirmities of body, but of Sound
Judgement and understanding and not knowing how soon the time of my
dissolution will be, I do therefore Committ my Soul into the hands of God
who gave it, and my body to the earth for a decent and Christian buriall,
Expecting by faith a Glorious Resurrection. And as for those worldly goods, 
which God in his Providence hath bestowed on me, I thus dispose of them when
my Just Debts and funerall charges are paid.
   Imprimis, I give unto my loving Wife Sarah one third part of my moveable
goods of Housing Stuf and Utencells thereto belonging to her disposall as
She Sees cause to dispose of them to my children by her; Alsoe, I give her
that third part of moveables of her former Husbands Estate which is yet
undivided. I Likewise give unto her the one third part of this my Real
Estate, here in Symsbury, with the Use of my now Dwelling house during the
term of Nathaniall's life, or as long as She continueth my Widow, and if by
the providence of God She be Married again, She Shall be allowed by my
Executors Six pounds a year, for the third of my Real Estate during life, to
be disposed of by her, among my Children by her.
   Item. I give to my Eldest Son John Higley, a double portion out of my
whole Estate, and to the rest of my Sons, Jonathan, Brewster, Joseph, and
Samuel, Nathanel, Josiah and Isaac, to each of them a Single portion out of
my whole Estate, with what either of them has already Received.
   Item. I give unto my daughters Katherine, Hannah, Elizabeth, and
Mindwell, Sarah, Susannah, and Abigail to each of them half so much as to
each of my Sons, Excepting John, out of my Estate, with what Either of them
have already received at Marriage, to be paid to them in Twelve months after
my decease, or at Eighteen years of age, by my Executors hereafter
mentioned.
   Item. My Will further is that my Sons Shall have all my Lands, they
paying to their Sisters what is wanting of the moveables to make up their
portions.
   Item. All the lands which I have at Windsor, which came by my first Wife,
I give to my five Eldest Sons which I had by her, in equall Share, they
paying to their four eldest Sisters twenty shillings each.
   Item. I give my wearing apparell unto my Youngest Sons, viz., Nathaniel,
Josiah and Isaac, and provided that Either of them, or their Sisters shall
dye before they are of age their portion Shall be divided among their
Survivors.
   Item. All my books, bonds, bills, and debts standing out I leave with my
Executors, and hereby Impower them for to Recover and cause to be added to
the Inventory of my whole Estate, they being Reasonably paid for their pains
and Costs.
   And I do hereby Appoint, Authorize, and Constitute my loving Sons John
Higley, and Samuel Higley to be my Executors to this my last Will and
Testament. In Witness whereof I have hereunto Sett my hand and fixed my
Seal, this the Six day of May, in the year of our Lord, God, One thousand
Seven Hundred and fourteen, and in the twelth Year of the Reign of Anne of
Great Britain, Queen &c. Anno Dom. 1714.

Will of James Pharo - May 30, 1688

Burlington Co., NJ Wills

   I give unto my son Gervas Pharow this plantation whereon I now live with
all the (unreadable) to him and his heirs forever when he comes of age. I
give unto my son James Pharow that plantation that John Milburn, the smith,
lives on lying near the land of John Bainbridge to him and his heirs forever
when he comes of age. My wish is that my dear wife Anne Pharow have the
(unreadable) of the above said land until my sons come of age. Also all of
my personal estate for long as she remains unmarried, but if she does marry
(unreadable)  And the rest to be divided equally among all my children but
it is my will that my son Gervis pay unto my two daughters, Anne and Mary
each of them a (unreadable) out of his share when they comes to age or be
married whether shall happen first. And whereas I have a certain share of
land I (unreadable) by my deed of the farm I give the share to my two sons
Gervis and James and to them their heirs forever to be equally divided
between them. And now I leave to my dear wife Anne Pharo (unreadable)  I
make constitute and appoint her to be executrix of this last will and
testament. I have here unto put my seal the 30th of the 3rd month called
May in the year of our Lord, 1688.

Will of Henry King - February 25, 1714

North Carolina Wills, 1663-1789, Vol. XVII, p. 34

   Know all men by these presence that I, Henry King, being now in my right
senses, and in good health, do with the grace of God and my own free will
make my last will and testament:
   Whereas, I have a full tract of land called the Log House land, being in
Chowan precinct, in the County of Albemarle,
   Whereas, the above mentioned land, I do freely give unto my three sons
Michael King, Henry King, Charles King; and the said land is to be equally
divided amongst these three.
   And, whereas, I have another piece of land being in Virginia in the
County of Nansemond lying between the flat swamp and the third swamp; and
whereas there is a part of the said land lies between the flat swamp and the
third swamp, that I do give to my two sons Michael King and Henry King, and
share and share alike between them two, one by Michael King, his choice.
   And, whereas, the other part of the same tract of land being between the
second swamp and the third swamp, I do freely give to my two older daughters
Elizabeth King and Catherine King; and they are to choose alike, one by
Elizabeth is to be her choice of the said land; and, I freely give to them
the tract of land being in the precinct lying upon the meadow.
   Whereas, I do freely give to my daughter Elizabeth one hundred acres of
the land; and to Catherine one hundred acres of said land.
   And, whereas, I do freely give to my daughter Ann King two hundred acres
of the said land.
   And, whereas, I do freely give to my daughter Mary King two hundred acres
of the said land.
   Whereas, this being my last will and testament.

Will of Balthasar Hussong - April 5, 1773

In the Name of God Amen  I Balser Heson of Frederick County & Province of
Maryland Tanner being sick & weak of Body but of sound & perfect Mind &
Memory Thanks be given unto Almighty God for his Mercies & callung unto
Mind the Mortality of my Body, & knowing that it is appointed for all men
once to die, do make Constitute & ordain this my Last Will and Testament in
manner & Form following that is to say principally and first of all I give
and recommend my Soul into the Hands of Almighty God who gave it and as to
my Body I recommend it to the Earth to be buried in a Christianlike decent
manner at the Discretion of my Executors, nothing doubting but at the
general Resurrection I shall receive the same again by the mighty power of
God & as touching such worldly Estate wherewith it has pleased Almighty God
to bless me with in this Life, after all my just Debts are paid & satisfyed
I give and devise and dispose of the same in the following manner and Form
Item I give and bequesth unto my dearly beloved Wife Margaret Heson her
maintainance during her natural life out of my Estate Viz. in Food and
Raiment sufficient & decent, also to have her Choice of my Swelling House
any Room or part she shall Chuse, and if it should happen that my said Wife
should not chuse to live in my Dwelling plantation with my Son Balser Heson
hereafter named & nominated, then my Will is that my said Wife shall have
the whole of my houshold Goods Together with all & every Utensil of the
Kitchen Beds & Furniture, Chests Tables & all & other Goods to me belonging.
Also my said Wife to have one horse, Mare or Gelding of her Choice & one
Milch Cow also of her Choice During her natural Life & at her Discease to
give & dispose of the same as she should think Proper.  Item I give and
Bequeath to my beloved Son Windle Heson the Sum of ten pounds Common Currant
Money to be paid by my Son Balser Heson in one year after my Discease.
Item I give and Bequeath to my beloved Daughter Ulion the Sum of ten Pounds
Currant Money in two years after my Discease.  Item I give and Bequeath unto
my beloved Son Peter the Sum of ten pounds Common Currant Money in three
years after my Discease.  Item I give and Bequeath to my beloved Daughter
Elizabeth the Sum of ten Pounds Currant Money to be paid four years after my
Discease.  Item I give and Bequeath unto my beloved Daughter Modlin the Sum
of ten pounds Common Currant Money to be paid five years after my Discease.
Item I give & Bequeath to my beloved Son John the Sum of ten Pounds Currant
Money to be paid in seven years after my Discease.  Item I give and bequeath
unto my beloved Daughter Catherine the Sum of ten pounds Common Currant
Money to be ppaid in eight years after my Discease also one feather Bed or
the Sum of three pounds Common Money in Lieu thereof.  Item I give &
bequeath unto my beloved Daughter Margaret the Sum of ten pounds Common
Currant Money to be paid in nine years after my Discease, also one Feather
Bed or the Sum of three pounds Common Money in Lieu thereof.  Item I give &
bequeath unto Avoh & Michael Tanner the Sum of five pound each to be paid
unto them by my Executor as they arrive at age.  Item I give & bequeath unto
my beloved Son Balser Heson my now dwelling Plantation Situate & lying in
Fredrick County & Province of Maryland Containing by Estimation one hundred
& thirty two acres & a half Called (Turkey Hill) to him his Heirs & Assigns
forever, together with all my Goods Chattels Lands Tenements, He the said
Baalser Heson paying performing fulfilling well and truely the Legacies
herein mentioned at the Times affixed and maintaining his said mother
Margaret Heson & providing for her all & every necessary of Life, but if it
should happen that my said Wife should not be content to live with my said
Son that then my said Son Balser shall deliver up all & singular my houshold
Goods of all Kinds Kitchen Utensels, in the whole to my said Wife, also the
Horse Mare or Gelding & Cow reserved of the Choice of my Stock & at that
Time of Delivery my said Wife shall immediately give up all her Right &
Title of Dower unto my said Estate of Lands &c & Claims therein unto my said
Son Balser Heson his Heirs & Assigns forever.  Item that if any of my
children should die without Heirs or before they arrive at age, that their
Part shall fall to my Said Wife if alive, if not, to my Son Balser Heson.
Lastly I do hereby constitute & ordain my beloved Sons Windle Heson & Balser
Heson Executors of This my Last Will & Testament, and do hereby utterly
revoke disannull & disallow, all & every other former & other Will & Wills
Legaces or Bequeaths Executors &c. by me before this Time made, Constituted
or ordained Ratifying and Confirming this & no other to be my Last Will &
Testament. In Witness whereof I the said Balsr Heson have hereunto set my
Hand & affixed my Seal this fifth Day of April in the year of our Lord God
seventeen hundred & seventy three.
